What is an employment pass?

The Employment Pass (EP) is a work pass for foreign professionals employed in management, executive or highly skilled positions in Malaysia. To apply for an EP, the applicant’s employer must first have been registered with the Expatriate Services Division (ESD) of the Malaysian Immigration Department.

The EP is valid for multiple entries into Malaysia and is not tied to a particular employer, unlike the Work Permit, which is only valid for one employer. An EP holder can also bring their spouse and children (under 21 years of age) to live in Malaysia on a Dependent Pass.

How to apply for an employment pass?

The application for an EP must be made by the applicant’s employer through the Expatriate Services Division (ESD) of the Malaysian Immigration Department. The employer is required to submit the following documents:

  • A copy of the company’s registration certificate
  • A copy of the Memorandum and Articles of Association or Partnership Deed
  • The business plan for the company
  • A copy of the applicant’s passport
  • A recent passport-sized photograph of the applicant
  • A copy of the job offer letter or contract of employment
  • Details of the company’s human resource structure
  • The proposed salary of the applicant

 

Once the application has been approved, the employer will be issued with an In-Principle Approval Letter. The applicant can then proceed to apply for their Employment Pass at the Malaysian embassy or consulate in their country of residence.

What are the requirements for an employment pass?

To qualify for an EP, applicants must meet the following criteria: 

  • They must be aged 18 years or above.
  • They must have a job offer from a Malaysian company that has been registered with the ESD.
  • They must be employed in a managerial, executive or highly skilled position.
  • They must earn a fixed monthly salary of RM5,000 (approximately US$1,300) or more. They must have the relevant qualifications, experience and skills required for the position.

Some of the benefits of having an employment pass include the following: 

  • It is valid for multiple entries into Malaysia.
  • It is not tied to a particular employer, unlike the Work Permit, which is only valid for one employer.

  • EP holders can apply for permanent residency status in Malaysia.
How long is an employment pass valid for?

An EP is initially valid for up to two years, after which it can be renewed for up to three years at a time. There is no maximum number of renewals.

  • They must not engage in any business or employment activities other than those stated in their EP.
  • They must not change their place of residence without the prior approval of the Malaysian Immigration Department.

Is there a minimum salary requirement for an employment pass?

Yes, there is a minimum salary requirement for an employment pass in Malaysia. The minimum salary requirement is RM5,000 per month. This means that you must be earning at least RM5,000 per month in order to qualify for an employment pass in Malaysia.

If you are not earning the minimum salary, then you will not be able to apply for an employment pass. There are other requirements that you must meet in order to apply for an employment pass, such as having a valid job offer from a Malaysian employer and being qualified to do the job that you are applying for. 

Can an employment pass be transferred to another employer?

Yes, an employment pass can be transferred to another employer in Malaysia. The process is relatively simple and straightforward and can be done in a matter of days. You must notify your current employer of your intention to leave and then submit a transfer application to the Immigration Department. Once your application is approved, you will be issued a new employment pass with your new employer’s details on it.

What happens if an employment pass is cancelled?

If an employment pass is cancelled in Malaysia, the foreign worker will be required to leave the country within 14 days. If they do not do so, they may be arrested and deported at their own expense. In addition, they will be barred from re-entering Malaysia for a period of two years.

What is the difference between an employment pass and a work permit?

An Employment Pass is issued to foreign nationals who are employed in managerial, executive or highly skilled positions in Malaysia. A Work Permit, on the other hand, is issued to foreign nationals who are employed in manual or low-skilled jobs. Employment Pass holders are not tied to a particular employer, unlike Work Permit holders, who can only work for the employer stated in their permit. EP holders are also eligible to apply for permanent.
